On October 19, Premier Li Qiang of the State Council recently signed a State Council order to promulgate the "Regulations of the People's Republic of China on Export Control of Dual-Use Items", which will come into force on December 1, 2024. The Regulations stipulate that the export of dual-use items and related activities shall abide by laws and regulations and shall not harm national security and interests. According to the Export Control Law, it is clear that the export control of dual-use items and other items related to safeguarding national security and interests and fulfilling international obligations such as non-proliferation shall apply these Regulations. At the same time, it is necessary to make joint provisions on the applicable rules of export control of items such as controlled chemicals. Cancel the registration system of export operators of dual-use items. Enhance the transparency and standardization of the export control policy of dual-use items, and clearly formulate the considerations and procedural provisions of the export control policy. Refine the facilitation measures for export control licensing of dual-use items and their application conditions and procedures. Clearly formulate and adjust the procedures and requirements for the control list and the implementation of temporary control, implement licensing for the export of dual-use items, and stipulate the conditions and procedures for applying for licensing. Strictly manage the end users and end uses of dual-use items, refine the control list system, establish a list of concern system, and improve the whole chain control measures.
