Coinbase has agreed to postpone the review of the appeal case, leading to speculation that the case may be nearing completion
The Securities Exchange Commission (SEC) previously requested that the deadline for responding to Coinbase's appeal be extended from February 14 to March 14, and Coinbase has agreed to this extension request.
The case, which dates back to June 2023, alleges that Coinbase provided unregistered securities and failed to meet its disclosure obligations. Coinbase has argued that crypto transactions on its platform do not constitute securities, seeking clarification on whether secondary market transactions meet the definition of an investment contract under securities laws. Previously, Judge Katherine Failla had granted Coinbase's request for an interim appeal and suspended all proceedings in the case until the Second Circuit Court reviewed the appeal. It is worth noting that the SEC's recently established Crypto Task Force, led by Commissioner Hester Peirce, who is known for his support of crypto, has sparked speculation that the long-term litigation may be nearing completion.
